피고인은 2010. 3. 중순경부터 2016. 06. 11. 11:10경 사이 부천시 원미구 소사로 482 소재 '부천종합운동장' 내에서, 관할행정관청으로부터 영업 신고를 득한 사실이 없이 약 3평 가량의 규모의 노상에 이동용 철재 테이블과 음식물을 조리할 수 있는 가스시설을 갖추고 이곳을 찾는 불특정 다수인을 상대로 소세지 및 닭꼬치, 옥수수 등을 조리, 판매하여 일일평균 2-3만원 상당의 수입을 올리는 등 무신고 영업행위를 하였다.
