A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On March 2018, the Defendant, “2018 Godan 846, 2018,” made a false statement against intellectual disabled persons as if they were to pay a mobile phone price and a mobile phone fee in lieu of the mobile phone fee, had them open his/her mobile phone in the name of them, and had them receive the phone by fraud.

The Defendant, at around 12:00 on April 2, 2018, was found to have become aware of the introduction of D, a mentally handicapped victim E, a mentally disabled person of the third degree of disability, who was aware of in the course of the introduction of D, a branch of the agency located in Jinnam-gun B around 12:0 on April 2, 2018.

“A false representation was made.”

However, the defendant was planned to use the mobile phone opened in the name of the victim for his/her own living expenses, etc., and even if he/she was transferred to a portable phone opened in the name of the victim, he/she did not have the intent or ability to pay the terminal price or the mobile phone fee or to prevent the victim from paying it.

Nevertheless, the Defendant: (a) by deceiving the victim as above; (b) caused the victim to open a cell phone amounting to KRW 1,557,600 at the market price; and (c) received the delivery of the phone X mobile phone; and (d) from that time until May 7, 2018, the Defendant received 18 mobile phones equivalent to KRW 23,141,00 in total market price from the victim of five by the following methods: (a) from May 7, 2018, the Defendant received 14 mobile phones of KRW 23,141,00 in total.

The defendant of "2018 Go-man 1167" declared that he/she would make a false statement against intellectually disabled persons as he/she would pay a mobile phone price and a mobile phone fee in lieu of his/her mobile phone, let them open his/her cell phone in the name of them, and take the means to defraud the relevant mobile phone.

The Defendant, at around 12:00 on April 2, 2018, came to know of the introduction of G coffee H in F at around 12:0 on April 2, 2018, to the victim I, who is a disabled person of the third degree with mental disability.
