Punishment of the crime

Defendant A is a person who operates a manufacturer of D in Gangseo-gu Busan Metropolitan Government Co., Ltd.

1. Around August 29, 2014, the Defendant entered into a lease agreement with the victim E Co., Ltd. with a view to setting the lease deposit of KRW 19,80,000,000 as KRW 19,80,000 for the first half of the year 2014 (the model name: PUMA 280), the lease period of KRW 48 months, the lease fee of KRW 507,375 for the first half of 4-48th, the amount of KRW 2,076,70 for the second half of 4-8th, the amount of KRW 2,076,05 for the second half of 200,000 for the second half of 20,000 won for the first half of 20.

Accordingly, the defendant embezzled the victim's property.

2. On June 30, 2017, the Defendant: (a) purchased one of the CNC AED machines owned by the victim at the J office operated by the victim located in Busan Seo-gu, Busan; (b) paid a down payment of KRW 2 million in advance; (c) paid KRW 10 million each month from July 25, 2017 to three months; and (d) concluded a sales contract stating that the ownership is reserved to the victim until the payment is completed; and (e) sold and delivered the same at the said D factory on August 31, 2017 to the “K” by delivering the CNC AED machines from the victim; and (e) sold and delivered the same at will on August 31, 2017.

Accordingly, the defendant embezzled the victim's property.

8. By the time of December 26, 200, a total of KRW 1.818 billion was loaned from the Greensan Branch of the Victim N Bank located in Gangseo-gu Busan Metropolitan City to five times in total under the pretext of a general loan, a facility loan, etc.
