Criminal facts
The Defendant and the applicant for medical treatment and custody (hereinafter referred to as “Defendant”) were hospitalized in C Hospital located in Busan Franc District Court B from December 3, 2014 to July 1, 2015, and on January 22, 2016, the Daegu District Court was sentenced to imprisonment for 8 months and medical treatment and custody due to the crime of interference with business, etc., and was hospitalized in the National Legal Hospital and the National Busan District Hospital from March 8, 2016 to April 2, 2018.
The Defendant committed each of the following crimes under the state that the Defendant lacks the ability to discern things or make decisions due to mental or physical disorder, such as “a person with a fluorial disorder who has a behavioral disorder due to damage network and exchange,” “a person with a fluoral disorder self-control,” “a person with a fluoral disorder,” and “a person with a fluoral father has reported his father.” Each of such crimes is caused by mental disorder and requires treatment at the medical treatment and custody facility, and there is a risk of repeating a crime due to mental disorder unless he/she receives a specialized mental therapy in the future:
1. Special violence;
A. On July 26, 2019, around 16:50 on July 26, 2019, at the convenience store located in Busan Northern-gu, the Defendant collected a large 115cm amount of alinium materials, which is a dangerous object kept at the above convenience store without any reason, and assaulted a part of the victim F (the 115cm amount in length, 49 years of age) who is an employee.
B. In front of the crosswalk near the above “E” convenience store, the Defendant assaulted the victim G (the age of 14) who was in the atmosphere of the pedestrian signal signal to the victim G (the age of 14), without any justifiable reason, at the front of the victim’s head 5 times, and assaulted the victim’s head at one time.
C. The Defendant, in the vicinity of the “I” store located in the Busan Northern-gu, Busan-do, Ha, Dak-gu, with the victim J (hereinafter referred to as 16 years of age) who walked along the road without any justifiable reason, flags the victim’s head head, and flag, which is a dangerous object.
