A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

No one shall possess, distribute, process, keep or sell fishery resources captured and gathered in violation of an order issued under the Fisheries Act or any products thereof.

The Defendant’s reason for sentencing selective punishment of imprisonment is the crime of violating the Employment Security Act, which was involved in the operation of the news release room in 2005, and in 2011, even though the Defendant had been punished for the suspension of the execution of imprisonment due to the crime of aiding and abetting in violation of the Game Industry Promotion Act, the crime is heavy in that the Defendant committed an offense with the aim of distributing the illegal capture knowing that the illegal capture was already made.

On the other hand, the punishment shall be determined as per the disposition, taking into consideration the favorable circumstances in which the confession of crime and the past illegal capture do not have any record of punishment.
