피고인은 2015. 2. 25. 10:00경 이천시 B에 있는 피해자 C(50세) 소유인 주택 신축 공사 현장에서 피해자가 피고인에게 위 주택에 대한 샷시 설치공사 대금을 지급하지 않았다는 이유로 위 주택의 출입문 손잡이를 다른 것으로 교체하고, 건물 안에서 일하고 있는 인부들을 밖으로 내보낸 후 출입문을 책상으로 막고 옥상 철제 난간에 ‘유치권 행사 중입니다‘는 현수막을 설치하는 방법으로 위력으로써 피해자의 주택 신축 공사 업무를 방해하였다.
