Reasons
1. The facts subsequent to the facts of recognition do not conflict between the parties, or are recognized by comprehensively taking account of the overall purport of the pleadings in each entry in Gap evidence 1, 2, 3, 6 through 9, Gap evidence 1, 2, Eul evidence 1, 2, 2, 9, Eul evidence 11-2 and 3.
A. On June 12, 2008, the Pakistan New Mutual Savings Bank (hereinafter “F”) completed the registration of creation of a neighboring mortgage with respect to H apartment No. 108-dong No. 3103 (hereinafter “the apartment of this case”) owned by the Whiteel Co., Ltd. on June 12, 2008, with the maximum debt amount of 1,274,000,000 won, and the debtor F Co., Ltd. (hereinafter “F”).
B. On June 13, 2008, the Pakistan Savings Bank: (a) 3 square meters in Busan Shipping Daegu, which was owned by F between F and F; (b) 10 square meters in J in Busan Shipping Daegu; (c) 12 square meters in K, 12 square meters in lots; and (d) 7 square meters in lots in lots (the land on the four parcels was all combined into G on February 19, 2010).
In addition to the joint security of the registration of the establishment of a mortgage near port area, the registration of the establishment of a mortgage on the land of the same day was completed on the same day.
C. D Co., Ltd. (hereinafter “D”) on June 13, 2008, jointly and severally guaranteed to F’s credit transactions with the Pacific Savings Bank up to KRW 1,300,000,000.
Between D and D on June 18, 2008, the Pakistan Savings Bank (hereinafter “instant real estate”) is the same as D’s 29,586 square meters of forest land E (hereinafter “instant real estate”) owned by D.
The registration of the establishment of a mortgage (hereinafter referred to as the "registration of a mortgage of this case") was completed on the same day, which was based on the additional contract to establish an additional contract to be added as a joint security of the registration of the establishment of a mortgage of this case, and the apartment of this case other than the above real estate was completed on the same day.
6 real estate in the aggregate of the four parcels of land was completed with the joint collateral registration of the instant collateral security registration as M in the joint collateral list.
