Reasons
Punishment of the crime
【Criminal Power】 On August 28, 2013, the Defendant was sentenced to two years of imprisonment and a fine of 300,000 won in Seoul Eastern District Court for the violation of the Act on the Aggravated Punishment, etc. of Specific Crimes. On June 13, 2015, the Defendant completed the execution of imprisonment with prison labor in Seongdong-gu District Court (in June 15, 2015, the name of the crime is changed to a "Habitual Theft" and the sentence is maintained at the same time) on June 15, 2015, and on October 25, 2012, a person who had been sentenced to ten months of imprisonment with prison labor at night and for larceny at the Gwangju District Court.
【Criminal Facts】
1. At around 05:00 on July 24, 2015, the Defendant: (a) intruded into the Fju place operated by E, the mother of the victim D, who is the mother of the victim D in Guri-si; (b) went out to the crogate, and was placed in the crogate; and (c) went out with the key to the crogate, and then cut off, the Defendant diversed the camba (124CC)’s market price, which is the victim’s possession, prior to the said crogate, by driving the camba (1.7 million won).
In addition, the Defendant habitually stolen the property amounting to KRW 12,327,00,00 in total eight times, as stated in the attached list of crimes.
2. Violation of the Road Traffic Act;
A. At around 05:00 on July 24, 2015, the Defendant driven G Yaba (124CC) that stolen as referred to in paragraph (1) without obtaining a motorcycle driver’s license on the front side of the Guri-si, Guri-si.
B. On July 27, 2015, at around 01:45, the Defendant driven a H Haba (124CC) which was stolen as shown in attached Table 2 No. 2, without obtaining a motorcycle driver’s license on the front day of the 293 diba-ro, Jung-gu, Seoul, Seoul.
C. On August 21, 2015, at around 14:35, the Defendant driven an IOba (124CC) that was stolen as shown in attached Table 5, without obtaining a motorcycle driver’s license, from the 10na-ro 10Na-ro 38, Cheongcheon-ro, Seongdong-gu, Seoul.
3. Fraud and violation of the Specialized Credit Finance Business Act;
