1. As to each land listed in the separate list of real estate, to the Plaintiff:
A. Defendant B is a senior governmental district court of the District Court.
Reasons
1. Basic facts
A. On January 2, 1999, the Plaintiff agreed with F as follows.
o Things subject to agreement: Gtel Nos. 711, 712, and 716 of Daejeon-gu Gtel shall be transferred to the Plaintiff until April 30, 1999, No. 711 and 712 of Daejeon-gu Gtel No. 711, and No. 716 shall be transferred to the Plaintiff until April 30, 199, but if the transfer is impossible by the above date, the sale price shall be returned.
B. The Plaintiff did not register the transfer of ownership by April 30, 1999. As F did not register the transfer of ownership, on August 24, 1999, the Plaintiff received a provisional attachment decision as to F-owned real estate with the claim amounting to KRW 131,852,00,000, and thereafter, received a favorable judgment on October 27, 2016 by filing a lawsuit seeking the return of the sale price of KRW 131,852,00 with the Suwon District Court KRW 2016Da4150.
C. F owned each land listed in the separate list of real estate (hereinafter “instant land”). However, as to the instant land, Defendant C completed the provisional registration of the right to claim ownership transfer on the ground of the pre-sale agreement as of May 15, 1999, received as No. 22246 on May 15, 1999. The registration of the right to claim ownership transfer was completed on the ground of sale as of July 10, 2002 by the above registry office No. 47662 as of July 11, 2002, as of the above registry office’s receipt of the right to claim ownership transfer registration as of July 11, 2002, as of the above registry office’s receipt of the right to claim ownership transfer registration as of October 14, 2004.
F owns a share of 507.371/165 of the 1657.5 square meters in the Daejeon Seo-gu I in addition to the instant land, and the said Daejeon-I land also owns a provisional registration of the right to claim the transfer of ownership under J as of April 10, 201.
