원심은 그 판시와 같은 이유로, 피고는 이 사건 조합의 원고에 대한 이 사건 대여금채무 중 원고의 손익분배비율에 해당하는 부분에 대한 이행을 거절할 수 있다고 판단하였다.

Examining the records in accordance with the relevant legal principles, although some inappropriate points are found in the reasoning of the judgment of the court below, the above judgment of the court below is justified.

There is no error of exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules, or by misunderstanding the legal principles on internal unions or the Supreme Court precedents, which affected the conclusion of the judgment.

Therefore, the appeal is dismissed, and the costs of appeal are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices.
