1. The defendant shall pay 86,00,000 won to the plaintiff and 12% per annum from March 5, 2020 to the day of complete payment.

The Plaintiff loaned KRW 100 million to the Defendant on October 11, 2016, and thereafter, the Defendant is obliged to pay damages for delay calculated at the rate of 12% per annum as prescribed by the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from March 5, 2020 to the date of full payment, since there is no dispute between the parties, or the Plaintiff has received reimbursement of KRW 14 million out of the above loans, and the Plaintiff is a person who has received reimbursement of KRW 14 million. As such, the Defendant is obliged to pay to the Plaintiff damages for delay calculated at the rate of 12% per annum as prescribed by the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from March 5, 2020 to the date of full payment, which is the day after the original copy of the instant payment order

Therefore, the plaintiff's claim of this case is justified and it is so decided as per Disposition.
