A defendant shall be punished by imprisonment for not less than two years and six months.
Reasons
Punishment of the crime
[2] On June 10, 201, the Defendant was sentenced to imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes in the Seo-gu Branch of the District Court of Daegu on June 10, 201, and completed the execution of the sentence in the Daegu Prison on October 5, 2012. ② On May 7, 2013, the same court was sentenced to imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny) and completed the execution of the sentence in the Daegu Prison on November 4, 2014; ③ on March 25, 2016, the Defendant was sentenced to imprisonment with prison labor for more than ten months and completed the execution of the sentence in the same prison on December 17, 2016 (hereinafter “each judgment”; and ② after the retrial, the Defendant was habitually sentenced to imprisonment with prison labor for more than one year and six years on May 17, 2017.
[Criminal facts] The defendant is habitually guilty
1. On January 20, 2017, around 19:10, the victim’s “D” bank located in the Seogu Daegu-gu Office C, Daegu-gu, by taking advantage of the gaps of surveillance neglected due to the victim’s game performance, etc., the victim’s E-game was stolen by having 30,000 won in cash, putting his/her hand on the part of the victim, including 30,000 won in cash, 1 copy of corporate bank body C card, 1 copy of license, 1 copy of Sike-gu card, etc., and 300,000 won in market price owned by the victim.
