1. The Defendant’s KRW 7,00,000 as well as 5% per annum from March 1, 2014 to April 23, 2014 to the Plaintiff.
Reasons
1. Facts of recognition;
A. On June 201, the Plaintiff: (a) sent the Defendant to the church, and maintained a de facto marriage and a de facto marriage on December 3, 2011; (b) filed a lawsuit against the Defendant on January 3, 2012 against the Seoul Family Court (the Seoul Family Court 2012Dhap129) seeking compensation for damages due to an unfair destruction of a de facto marriage relationship.
B. On May 10, 2012, a voluntary conciliation was established between the Plaintiff and the Defendant to the following purport.
The defendant shall pay to the plaintiff KRW 30 million by June 30, 2012, and the plaintiff's mixed goods kept by the defendant shall be owned by the plaintiff, and the defendant shall immediately return the above goods to the plaintiff as of the mediation date as they are. The defendant shall not conduct any act such as grasping the trend of the plaintiff without the plaintiff's consent, failing to conduct any act, and bear any punishment when violated.
C. However, around October 2013, the Defendant posted a letter stating that “the Plaintiff and the Plaintiff’s family members have neglected or unjustly treated the Defendant,” and posted a photograph relating to the Plaintiff, such as the Plaintiff’s photograph and the Defendant’s photo, etc., together with the Plaintiff’s photograph and the Defendant’s photograph around November 2013.
On December 2, 2013, the Plaintiff, who became aware of it, requested C to delete the notice related to the Plaintiff, and received the report on the harmful post at the following Daum and the Customer Center, and took measures to eliminate or limit access to the notice.
However, the Defendant posted the Plaintiff’s pictures related to the Plaintiff on various sites as follows to the effect that the Plaintiff’s family members treated the Defendant unfairly.
