A defendant shall be punished by imprisonment for two years.

Punishment of the crime

[Criminal Power] The Defendant was sentenced to six months of imprisonment for larceny at the Incheon District Court on December 18, 2013 and completed the enforcement of the sentence in the Incheon Prison on May 7, 2014, and was ten criminal offenders of the same kind.

[Habitual Larceny and Unlicensed Driving] From August 2014 to October 2014, the Defendant served as an employee at F Co., Ltd., Ltd. operated by the victim E in Namdong-gu Incheon Metropolitan City from the point of view to October 2014. Since the retirement of the Defendant, the Defendant attempted to steals the freight vehicles and waste cables in order to steal waste electric wires stored in the company and transport waste electric wires in mind by raising living expenses due to the theft of waste electric wires and to contribute to transporting waste electric wires. The Defendant attempted to steal waste electric wires, scrap metals, etc. stored in the manufacturing company and recycling center, etc. without the driver’s license.

At around 01:00 on October 26, 2014, the Defendant: (a) boarded the cargo vehicle with a key at a G-wing-house level equivalent to KRW 2,00,00,00 in the market price owned by the victim, which is parked in a state where the key is displayed, and moved the vehicle to the entrance of the said company; (b) loaded approximately KRW 50,000,000 in the front of the entrance, carrying approximately 1,00,00,000 in the closed electric wire at the front of the entrance, carrying the said cargo vehicle and waste cable onto the said cargo vehicle; and (c) driven the said cargo vehicle without obtaining a driver’s license from the said F to the trade influor in the south-dong drawing or front road.

In addition, the Defendant habitually stolen approximately KRW 1,324,00 over 20 times from the above date to February 21, 2015, as indicated in the annexed Table 1, as shown in the annexed Table 2, and driven the above cargo without obtaining a driver’s license over a total of 20 times, as shown in the annexed Table 2.
