Reasons
Punishment of the crime
Defendant
A is the president of G private taxi association, and Defendant B is the accounting of the above association, and Defendant C is the general affairs of the above association.
1. As between July 10, 2010 and August 30, 2010, Defendant A and Defendant C sold an automobile exhaust to its members at the above partnership office located in Dongducheon-si H in Dongcheon-si, an automobile exhaust to KRW 65,00 per unit.
However, in fact, G Private Tax Association received 63,000 won per automobile dispatch from I, which is the business partner, and collected and delivered to I, and received 3,000 won in return for I.
Nevertheless, Defendant A and Defendant C have concealed each of the above facts to its members during the above period, sold 65,000 won a new one to the victim J, a partner, and acquired pecuniary benefits equivalent to KRW 2,000 from such gains. Defendant A and Defendant C acquired pecuniary benefits equivalent to KRW 3,000 in total by collecting and delivering one copy of the ship used by the said victim to I. It acquired pecuniary benefits equivalent to KRW 5,000 in total.
2. Defendant B sold to its members at the place described in paragraph 1. from October 201 to June 201, 201, an automobile exhauster of KRW 65,00 per unit and KRW 75,00 per unit from July 2011 to December 2013.
However, in fact, G private taxi unions received 63,000 won per truck from October 201 to June 201, 201, 73,000 won per truck from July 201 to December 201, and 3,000 won per truck from July 201 to December 2013, and received 3,000 won per truck from the members to the I for recovery and delivery.
Nevertheless, Defendant B concealed each of the above facts to its members on October 2010, sold a new distribution unit of KRW 65,000 to the victim K and obtained 2,000 property gains from such gains, and one distribution unit of the distribution unit of KRW 3,000 is included in the property amounting to KRW 3,00 by collecting and delivering it to I.
