A defendant shall be punished by imprisonment for one year.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

C is a corporation with the purpose of pipes heating work business, and the defendant is the representative director of C.

1. Forgery of public documents and the uttering of forged public documents;

A. The Defendant had registered the construction of heating construction business in the name of an individual in the past, but was cancelled on May 22, 2013. However, the Defendant thought that C, a large-scale apartment cleaning company, whose representative director, is the corporation, participated in the bidding and was awarded a successful bid. As such, the Defendant attempted to forge the construction business registration certificate for C in the name of Nowon-gu using the existing personal registration certificate form.

Accordingly, the Defendant, at the office of “C” located in Seoul Special Metropolitan City, Nowon-gu around the wintering in 2013, proves that he/she is a constructor under Article 9 of the Framework Act on the Construction Industry in the column of “he/she is a corporation” in the column of “he/she conducts heating construction business”, “F”, and “name of a corporation” in “A” and “representative” in “A” and “the location of the main place of business” and “D” and “(corporate) registration number” in “G”, “Korean nationality or national name” and “registration date” in “G”, “Korea”, “registration date”, and “the above person” is a constructor under Article 9 of the Framework Act on the Construction Industry.

The term "the head of Nowon-gu", "the 18th June, 2007," and "the head of Nowon-gu" printed his official seal using a computer.

Accordingly, the defendant, for the purpose of exercising his official document, forges one copy of construction business registration certificate against C in the name of Nowon-gu, a public document.

B. On June 12, 2014, the Defendant, using the above forged registration certificate of C’s construction business, filed an application for a bid with the management office of H “I apartment” company located in Songpa-gu Seoul, Songpa-gu, for the above I apartment boiler customs company’s selection, submitted the application document to the management office and submitted the forged registration certificate to the employees under the name and poor working at the management office, and (2) on June 2014.
