1. The defendant Korea Land and Housing Corporation shall be 59.0295.295.
Reasons
1. Basic facts
A. The Defendant Korea Land and Housing Corporation (the Korea National Housing Corporation and the Korea Land and Housing Corporation were established through a merger on October 1, 2010; hereinafter “Defendant Corporation”) sold to K the area J674 square meters and G674 square meters, which is a commercial site in the said area of the housing site development project, on December 23, 2002. The said land purchaser status was finally succeeded to Defendant M&D Co.,, Ltd (hereinafter “Defendant Company”) on August 24, 2004 through a successive resale.
Since then, on May 18, 2006, the land subject to the sale was pointed out as F. 674.4 square meters in Bupyeong-gu Incheon Metropolitan Government and G large 674.4 square meters in size (hereinafter “instant land”) and registered the preservation of ownership in the name of the Defendant Corporation was completed.
B. The Defendant Company newly constructed a “L building” (hereinafter “instant building”) falling under Class 1 and 2 neighborhood living facilities, as an aggregate building with the size of the second and eighth underground floors above the ground, using the instant land as the site, and completed the registration of initial ownership as to the instant building on August 31, 2006.
C. Of the instant building, the Plaintiffs received the Plaintiff’s exclusive ownership portion and its site ownership share directly from the Defendant Company or receive them from the buyer, and paid the purchase price in full (hereinafter “instant exclusive ownership”), and the Plaintiffs completed the registration of ownership transfer only with respect to each section of exclusive ownership listed in the separate sheet No. 2 as indicated in the separate sheet No. 2, which was after the registration of ownership preservation was completed with respect to the instant building.
Of the instant land, the aggregate of the share of a site falling under the instant exclusive ownership is 59.02295/674.4 square meters in Bupyeong-gu, Incheon, Bupyeong-gu, and 59.0295/674.4 square meters in common among the share of 674.4 square meters in Bupyeong-gu, Incheon and Bupyeong-gu, Incheon (hereinafter collectively referred to as “instant exclusive ownership”).
