[Defendant A] The defendant shall be punished by imprisonment for one year.

However, the above sentence shall be executed for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2019Kadan806] After the Defendants opened a fake gambling site (tentatively referred to as “D”, “E, etc.”), which does not receive money from the victims, with their names, and opened a fake gambling site (tentatively referred to as “franch site”), the Defendants attempted to transmit public relations letters on the above site to unspecified persons through DB, thereby inducing them to join the said site, and if the victims request money exchange after having access to the above site and gambling, they made an error on the part of the victims. In order to do so, the Defendants agreed to deposit more money without doing so by means of doping, such as “franch site,” and then divided the money.”

As a result, Defendant A and Defendant B purchased personal information DB, fake gambling site, largephone, and large passbook, and sent promotional letters to many unspecified persons through DB, and manage the overall site. Defendant C organized necessary data in advance purchased personal information DB, and posted answers using a ecce program when victims request exchange on a fake gambling website, and reported the details deposited on each website to Defendant A and Defendant B.

Defendant

On November 18, 2018, A and Defendant B sent a false text message to the victim H’s cell phone with the content that “the points have been charged to the D site” in the F apartment G of Seo-gu Incheon, Seo-gu, Incheon. The victim sent a false text message to the victim H’s cell phone. The victim visited the said website to gambling, and then made a false statement to the effect that “the request for exchange is due to the fact that the refund is to be extinguished, the amount of KRW 190,000 shall be deposited in the bulletin board, and the server problem
