1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. In the name of B, the Plaintiff, who is engaged in the textile manufacturing business, entered into a contract between A and LTD (AND A TRAVLING GADDD) in Bangladesh-si LTD (hereinafter “non-party company”) to export the original parts produced by the Plaintiff to the non-party company.
B. On November 29, 2015, at the request of the non-party company to issue a letter of credit, the Defendant’s point of DHKA (hereinafter “C”) (hereinafter “BHA branch”) issued an irrevocable letter of credit (hereinafter “written credit numberC”) with USD 26,69.86, U.S. dollars 26,69.86, the date of the final shipment of which is December 15, 2015, with the Plaintiff, the drawee, the issuing bank, and the advising bank, the issuing bank.
1) Goods that can be shipped by partition 2: Bronron 11,03, Wron 11,03, Wron 23 July 2015, the beneficiary’s estimate invoice (PROFOINVE) NO.D.
C. On July 28, 2015, prior to the issuance of one letter of credit, the Plaintiff loaded the said goods, and on December 22, 2015, the Plaintiff received the collection amount from the National Bank, which is the issuing bank of the said letter of credit.
On December 1, 2015, at the request of the non-party company to issue a letter of credit, the judgment below issued an irrevocable letter of credit (the letter of credit number E; hereinafter referred to as "second letter of credit") with USD 23,303.6, which is the date of the final shipment as of January 19, 2016, with the Plaintiff, the drawee, the issuing bank, the issuing bank, and the advising bank, the issuing bank.
1) Goods that can be shipped by partition 2: Bronron 10,132 Camp, and detailed statements are estimated invoices (PROFOINVE) by the beneficiary on July 23, 2015, see N. F
E. On December 5, 2015, the Plaintiff loaded the goods and received the collection amount from a national bank, which is a credit notification bank, on December 23, 2015.
F. On May 2, 2016, at the request of the non-party company to issue a letter of credit, he/she received the request from the non-party company, and on May 2, 2016, the Plaintiff, the drawee, and the advising bank, the issuing bank, the national bank, and the expiry date.
