A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

1. On September 1, 2009, the Defendant issued a summary order of a fine of two million won at the Jung-gu District Court for a violation of the Road Traffic Act, and on January 21, 2011, the same court was sentenced to a suspended sentence of one year and six months for a violation of the Road Traffic Act, and the said judgment became final and conclusive on January 29, 201.

2. Criminal facts;

A. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Doing Vehicles) and the Road Traffic Act (Non-accidenting Measures) are drivers of B Abeo vehicle.

On February 16, 2014, at around 00:15, the Defendant was under the influence of alcohol with 0.138% of blood alcohol concentration, and the Defendant was driving the said Abea car at the above Abea, and the Defendant was driving four lanes in front of the entrance of the 1563 Hyundai Apartment-ro, Jyang-gu, Jyang-si, Jyang-si, Jyang-si, Seoul, with four lanes in front of the entrance of the 1563 modern apartment.

In such cases, a driver of a motor vehicle shall not drive the motor vehicle while under the influence of alcohol, and has a duty of care to prevent accidents by safely examining the boom and driving the motor vehicle safely.

Accordingly, the Defendant suffered injury to the victim, such as cerebrovasin in need of treatment for about two weeks due to such occupational negligence, and at the same time, destroyed the victim's rocketing taxi by approximately KRW 778,534 to repair cost, and escaped without taking necessary measures on the spot, such as immediately stopping the taxi to rescue the victim, and identifying the personal information of the defendant.

B. A defendant who violates the Road Traffic Act shall be prohibited from driving under the influence of alcohol not less than twice.
