1. The Defendant: KRW 82,535,100 for the Plaintiff and KRW 5% per annum from July 22, 2016 to October 26, 2017.
Reasons
1. Facts of recognition;
A. The Plaintiff is a person engaged in the manufacturing and retail business of general hardware and glass with the trade name of “C,” and the Defendant is a person engaged in construction business with the trade name of “D.”
B. On June 8, 2015, the Defendant entered into a subcontract construction contract (hereinafter referred to as the “subcontract 1”) with respect to the construction period for the creative and glass construction among the new construction works for the same heading E, 200,000 won from May 25, 2015 to June 20, 2015, with respect to the construction work for the same heading E, 1,000 (5 households, 14,000 won per household, and 14,000 won per household).
B) On April 12, 2015, the Defendant: (a) between G and H operating the said F and the construction period for the installation of facilities among the new construction works of the same Dual E’s detached housing; (b) between April 12, 2015 and May 20, 2015, the construction period for the installation works; and (c) between 37,500,000 won for construction works (five households, five households, five hundred five thousand won for each household, and five thousand won for each household); and (d) concluded a subcontract agreement for the subcontracted construction works (hereinafter referred to as “second subcontract agreement for construction
(C) Among the first subcontracting contract, the sewage supplier column includes the name of the defendant and the seal of the defendant, and the sewage supplier column bears the seal of the defendant in the second subcontracting contract. The seal of the defendant and the defendant's spouse I is affixed to the sewage supplier column.
