A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.
Reasons
Punishment of the crime
The defendant, as the representative of the B civil engineering design office, has been engaged in the work with C, D, E, and F, used 1,50,000 won for the agency fee for the occupation and use permit of public waters by Hongcheon-gun G, which was entrusted with the occupation and use permit of public waters by the E, but did not carry out the permitted work from E, with the intent of forging the official notice of the occupancy and use permit of public waters and the permit of use of public waters (the occupancy and use) to exercise the right.
1. Forgery of an official document;
A. On August 11, 2014, the Defendant: (a) received “the notice of permission to occupy and use public waters” by using a computer at the above B-B Design Office in Hongcheon-gun, Hongcheon-gun, Hongcheon-gun, for the purpose of creating a detached house, access road, and site farmland; (b) obtain conditional permission pursuant to Article 8(1) of the Public Waters Management and Reclamation Act with respect to the matters for which the Defendant applied for the permission to use the public waters; (c) grant the following conditional permission in accordance with Article 8(1) of the Public Waters Management and Reclamation Act.
With respect to this permitted permit, registration license tax and public waters points according to the license, the user fee is paid, and the license for occupancy and use of public waters is received.
In addition, if the permitted area is incorporated or damaged due to public works, etc. pursuant to Article 20 (Disposition for Public Interest) of the Public Waters Management and Reclamation Act, any objection or loss compensation may not be requested, and this permission can be cancelled when civil petitions, interested parties, etc. occur, so it is time to prevent civil petitions in advance and comply with the terms and conditions of permission thoroughly.
