A defendant shall be punished by imprisonment for three years.

Punishment of the crime

The Defendant, “2019 Highly 75,” under the trade name of “C” in Kim Jong-si, performed the work of manufacturing and delivering the first class malmpium, which is the ground cable pipeline, in the name of “C” in “C,” and was supplied polyethylene, which is the raw material of the marri, from around 2011, to the G, operated by the victim F.

In the process of manufacturing and supplying goods by OEM under the name of “Co., Ltd. D”, the Defendant was aware of the victim, i.e., “We are directly supplying companies prior to Korea, and we do not know about how to pay the price when trading with Korea.” The Defendant had a debt of KRW 200 million borrowed from the Korea Technology Finance Corporation around October 2013, and there was no specific property under the Defendant’s name. From around 2014, C had started to increase its sales from around 2014, and from around 2015, C continued to purchase polyethylene from the victim, it was impossible to pay the price normally after the lapse of time, and at the same time, the credit amount was demanded to pay from the victim, and at the same time, it was 200 million won to the victim’s wife and 300 million won, and the fact that the Defendant continued to receive 4 billion won or more from the victim’s wife and 200 billion won of the outstanding amount.”

Ultimately, the Defendant continued to deceive the victim as if he did not have any intent or ability to pay the price in time even if he/she had been continuously traded with the victim at the above C plant on June 12, 2015, and was supplied with polyethyl materials equivalent to KRW 44,00,000 from the victim.
