1. The Defendant shall pay to the Plaintiff KRW 52,050,000 and the interest rate of KRW 15% per annum from July 22, 2016 to the day of complete payment.
Reasons
1. From January 2012 to April 14, 2016, the Plaintiff: (a) transferred KRW 23.5 million from the Plaintiff’s Han Bank Account (Account Number: C); (b) KRW 1.1.3 million from the Plaintiff’s new bank account (Account Number: D); and (c) KRW 29,3510,000 from the Plaintiff’s new bank account (Account Number: E); and (d) KRW 13.1 million from the Plaintiff’s new bank account (Account Number: D); and (c) KRW 366,62.66 million from the Plaintiff’s new bank account (Account Number) to the Plaintiff’s new bank account.
Therefore, the defendant is obligated to pay 520,050,000 won and damages for delay remaining after the loan to the plaintiff.
2. Article 208 (3) 3 of the Civil Procedure Act of the judgment by publication.
