1. The defendant shall be punished by imprisonment for eight months;

2.However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On June 19, 2014, the Defendant was issued a summary order of KRW 1 million for a crime of violating the Road Traffic Act (drinking driving) at the Jeju District Court, and on July 21, 2015, the Defendant was issued a summary order of KRW 4 million for the same crime at the same court.

1. The Defendant is a person who is engaged in driving a B car free of license in violation of the Road Traffic Act (unnecessary Measures after Accidents) and the Road Traffic Act (unlicensed Driving).

On March 28, 2016, the Defendant driven the said car without a driver's license on March 28, 2016, and turned down from the first lane in front of the D cafeteria located in the Heung-gu Seoul Metropolitan City, Chungcheongnam-gu to the speed unstened in the city.

At the time, there was a parked vehicle in the rear, so there was a duty of care for the person engaged in driving service to live well in the rear side and to operate the brake system accurately and safely.

Nevertheless, the Defendant neglected to do so and did not discover a F F-W car parked by the victim E (35) at the later bank due to negligence, and received the front part of the damaged vehicle due to the lower part of the Defendant’s driver’s vehicle.

Ultimately, even though the Defendant damaged the damaged vehicle to take approximately KRW 1,737,550 of the repair cost by occupational negligence above, the Defendant left the vehicle without immediately stopping and taking necessary measures.

2. On March 28, 2016, the Defendant driven a motor vehicle under the influence of alcohol, such as being driven by a police officer belonging to the Cheongju-gu Gung-gu Seoul Metropolitan Police Station Gung-gu, Cheongju-gu, by drinking alcohol on the road in front of the D cafeteria in Cheongju-gu, Chungcheongnam-gu, Cheongju-si, while driving a B Karen-gu car under the influence of alcohol by drinking the motor vehicle in front of the D cafeteria in Cheongju-gu, Cheongju-gu.

The measurement of drinking is conducted by inserting approximately 30 minutes of the same day from around 01:02 to around 01:32 of the same day, as there are reasonable grounds to determine a seal.
