Defendant
A shall be punished by imprisonment with prison labor for ten months, and imprisonment with prison labor for six months.
However, from the date this judgment became final and conclusive, the defendant.
Reasons
Punishment of the crime
"2016 Highest 581"
1. On November 2, 2015, Defendant A, a joint thief of the Defendants, committed the crime of larceny, was provided as security by possession revision, with 30,000 won to the victim F, who was aware of in the course of Defendant B’s introduction at the E notarial office located in the front Eup/Eup/Myeon prior to the due date (3,00,000 won, monthly interest rate of April 1, 2016), 1 fishing vessel G (3.41 ton, coast line network, fishing vessel number H) owned by the injured party, 2 fishing vessel engines installed in the above G (250 E) as security, and Defendant B provided the said debt jointly and severally, and Defendant B urged the victim to pay interest and principal in the event that interest cannot be paid from the injured party from January 2, 2016.
However, around February 12, 2016, Defendant A, upon receiving a proposal from Defendant B to the effect that “the victim tried to dispose of the outboard engine installed in G, and the victim would first bring us before selling the outboard engine,” thereby soliciting the Defendants to commit two thefts of the above outboard engine installed in G owned by the victim.
On February 17, 2016, the Defendants: (a) committed a theft of the victim’s property by having I, a vessel repairer, depart from 20,000,000,000 won in total from the market price of the victim’s possession in the said G; and (b) requesting I to sell it.
2. The sole criminal conduct of Defendant A;
(a) No person who violates the Interest Limitation Act shall receive interest exceeding 25% per annum, which is the maximum interest rate for lending and borrowing of money under the Interest Limitation Act;
Nevertheless, on November 2, 2015, the Defendant lent KRW 30,000 to F on the condition that he/she repaid from E notarial offices to April 1, 2016, as described in paragraph 1, and set the interest thereon at KRW 3 million per month.
