A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On May 5, 2018, the Defendant: (a) established a floating corporation and opened an account in the name of the corporation, and (b) established a floating corporation that has no substance to create a prompt-use passbook in the name of the floating corporation; and (c) conspired with B to transfer the means of access used in the connected electronic financial transactions to B.

1. In accordance with the above public offering, the Defendant: (a) around May 9, 2018, in the registration division of the Incheon District Court located in 17, 163-ro, Michuhol-gu, Incheon, Michuhol-gu, Incheon, in accordance with the foregoing public offering, the Defendant paid KRW 10 million in capital for the purpose of developing and selling software, even though the Defendant was a director in company and did not intend to actually establish and operate a corporation; and (b) as if the Defendant established “stock E” in the Incheon Gyeyang-gu, Incheon, where the head office is located, the office is located; (c) the Defendant prepared related documents, such as the Defendant’s certificate of personal seal impression, resident registration certificate, and proxy letter, and submitted to the public official in charge of the establishment of a false corporation including the above documents, and had a public official in charge enter the above application in the corporate register of the certified commercial registration information system; and (d) recorded the fact in the certified commercial registration system on the same day and recorded it in the certified commercial registration register through a false report in the same way as the original electronic information system.
