A defendant shall be punished by imprisonment for three years.

Punishment of the crime

From January 2013 to May 2014, the Defendant was a member of the accounting of the Dispute Resolution Co., Ltd. (Representative D) and E (Representative F) who is a non-affiliated manufacturer.

1. On January 22, 2013, the Defendant: (a) purchased money from the victim D in Sejong Special Self-Governing City’s office in the Special Self-Governing City Special Self-Governing City, with the loan of money to the bank loan and bond, etc.; and (b) purchased money from the Daejeon Special Self-Governing City. If the money is lent, the Defendant would be able to repay the money when selling the commercial building. It would be able to lend money that can be repaid in order to ensure the stable workplace life at this place.”

In fact, the Defendant continued to make a false statement to the victim until April 10, 2013, while receiving a total of KRW 90 million from the victim on six occasions as shown in the attached Table 1 of the Punishment of Crimes, from the time on which the Defendant received a false statement from the victim until April 10, 2013, and acquired it under the name of the borrowed money, even though he did not purchase the doping shop in Daejeon, even though he had already borrowed a large amount of money from the victim, even though he did not have any intent or ability to repay it even if he borrowed money from the victim because he had already borrowed money from the victim due to a large amount of money.

2. ㈜C 직원급여 허위조작 사기 피고인은 피해자 ㈜C의 경리로서 회사의 직원급여를 지급하는 업무를 하면서 피해 회사가 직원들에게 지급해야 할 급여 금액을 허위로 부풀려 보고하는 방법으로 속여 그 차액을 가로챌 것을 마음먹었다.

On January 3, 2014, the Defendant presented a false draft disbursement resolution to D, who is the representative director of the victimized company, at the same place, and concluded that “The Defendant’s approval on the withdrawal money list to withdraw KRW 60,141,590 from the Company’s passbook to the total sum of the C employee’s wages on December 2, 2013.”
