A defendant shall be punished by imprisonment for one year.

Punishment of the crime

From the end of November 2011, the Defendant was suspected of embezzling 300 million won of the company’s public funds by the victim from around December 2, 2010, the Defendant, “2012 Highest 664,” and the Defendant, from the end of November 2, 2011, did not work in the company since January 2, 2012. On January 5, 2012, the Defendant, knowing that the victim filed a complaint for embezzlement of the Defendant, was able to find materials favorable to himself by entering the said company’s office.

At around 23:50 on January 9, 2012, the Defendant opened an entrance to the second floor through the stairs and entered into the office, and infringed upon the opening of the office of the president’s room inside the office, which is inside the office.

Accordingly, the defendant invadeds on the building managed by the victim.

The Defendant, from October 10 to January 2, 2012, 2012, worked as an employee in charge of accounting in charge of the revenue and expenditure of the F Co., Ltd., G Co., Ltd., and D Co., Ltd., Ltd., in Jeju, and kept the funds deposited in the Agricultural Cooperative Account in the name of the said three companies (F Co., Ltd., HI, G Co., Ltd, J, K, D Co., Ltd, M, and N).

1. Occupational embezzlement;

A. On February 21, 201, the Defendant embezzled 20,000,000 won deposited in F’s account using Internet banking in the foregoing office, and embezzled 10,000,000 won for the repayment of P’s debt, using the remainder as a living expense, such as air fees, and embezzled 16 times in total, as shown in attached Table 1, by arbitrarily using 16,07,316,062 won in total.

B. The Defendant’s occupational embezzlement against the Victim G Co., Ltd.: (a) around February 17, 201; (b) KRW 3,00,000,000, deposited in the G account, from the Ansan Agricultural Cooperatives located in Seopo-si, Seopo-si; and (c) the Defendant deposited in the G account.
