The defendant shall be paid KRW 120,000,000 from the plaintiff and at the same time real estate stated in the attached Table to the plaintiff.
Reasons
(b) the facts of the basis;
A. The Defendant is a company established for the purpose of real estate development business, etc., and is the owner of a new construction of a main center located in D District in Daejeon-dong C District (hereinafter “instant commercial building”).
B. On April 29, 2016, the Plaintiff paid KRW 250 million to the Defendant.
* The total sale price (including value added tax) under Article 1 (1) (1) (the sale price and payment method) of the 3rd floor SHP E (100 square meters for the commercial building of this case) of the commercial building of this case is KRW 500 million for the purpose of sale (10 million for the separate drawing, and calculated according to the share of the site and the ratio of the total number of stories after the trend of the common use area). (2) The date of the payment of the sale price, the down payment and the intermediate payment: the details of the payment of KRW 300 million for the 300 million on April 29, 2016, KRW 250 million for the 10 million on June 30, 2016, KRW 100 million on November 30, 2016, KRW 200 million for the remainder of KRW 200 million on November 30, 2016, without obtaining the Defendant’s obligation to transfer or acquire the ownership in accordance with this contract.
Article 3 (Termination of Contracts) The defendant may not terminate this contract.
Article 4 (Penalty) The defendant shall compensate for the above contract matters when the ownership shall not be transferred by December 31, 2017.
Article 5 (Other Matters) (1) The defendant needs to provide funds for the commercial buildings of this case before the regular sale, and the defendant is paid the down payment and intermediate payment by selling the third floor SHPE, so the defendant is paid the down payment and intermediate payment. Therefore, the defendant shall prepare and substitute the sale contract for the third floor SHOPE immediately after the regular sale of this case under the same conditions (area of sale, number of floors of sale, and amount of sale).
(2) Matters not specified in this contract shall be determined by consultation between the plaintiff and the defendant, and matters not agreed upon shall be governed by the relevant laws and regulations and the general practices, and if a dispute arises, the lawsuit against this contract shall be determined by the court having jurisdiction

On November 30, 2016, the Plaintiff and the Defendant are as follows with respect to the instant commercial buildings.
