Reasons
1. Details of the disposition;
가. 원고는 B생으로 (주)휴먼스텝스 소속 근로자이고, (주)휴먼스텝스가 지정한 근무지인 C공장(이하 ‘이 사건 공장’이라 한다)에서 경비원으로 근무하였다.
After completing night work on August 3, 2013, at around 09:00, the Plaintiff arrived at the Daejeon East-gu Down-gu 201, Daejeon-gu, Daejeon-gu, Dalla 201. On the same day, at around 09:15, the Plaintiff was sent back to the Daejeon-si Emergency Hospital for the 119 Emergency Service.
B. On October 29, 2013, the Plaintiff filed an application for medical care benefits with the Defendant “cerebral blood, high blood pressure, and bath.”
C. On December 10, 2013, the Defendant confirmed on December 10, 2013 that “the Plaintiffs did not confirm the unique work hours within 24 hours prior to the outbreak of a disease, and confirmed that “the average work hours of 49 hours per week prior to the outbreak of a commuting Card, 59.57 hours per week average work hours per 4 week prior to the outbreak, and 62.14 hours per week average work hours per 62.14 hours prior to the outbreak.” The Defendant was unable to recognize a proximate causal relation on the grounds that: (a) the daily work hours and work hours per week prior to the outbreak does not exceed 30% of the daily work hours; (b) the average work hours and work hours per week prior to the outbreak exceed 60 hours per week; (c) it is deemed that the atmosphere and break time were included; (d) it is difficult to deem that there was an occupational fault due to the determination that there was a physical and mental penalty to the extent significantly affecting the normal functions of the previous brain outbreak.” (hereinafter referred to as “instant causal relation”).

2. Whether the instant disposition is lawful
A. The Plaintiff asserted that the average working hours per week during four weeks prior to the outbreak, 69 hours and 15 minutes per week, and the average working hours per week during 71 hours per week prior to the outbreak, exceed 60 hours per week.
