피고인은 2013. 10. 20.경부터 같은 달 24. 20:00경까지 부천시 원미구 C 3층에 있는 피고인이 운영하는 ‘D’ 게임장에서, ‘골드다빈치’ 게임물 39대를 불특정 다수의 손님들에게 이용하게 하면서, 위 게임물이 게임물등급위원회로부터 이용자의 순발력과 직관력이 필요하고 단순히 운에 의해 아이템카드를 획득할 수 없는 게임물로, 각 스테이지 마다 3개의 그림이 화면에 표시되고, 이용자는 3개의 그림 중에 한 개를 선택하여 제시한 비슷한 그림 3개가 표시되면, 이용자는 1~3버튼을 이용하여 다른 그림을 찾는 게임물로 등급분류를 받았음에도 불구하고, 위 게임장에서 손님들에게 제공하는 게임물은 이용자의 능력과 무관하게 자동진행장치(일명 : 똑딱이)를 이용하여 게임을 하여도 아이템 카드가 배출되는 구간인 3단계 이상까지 클리어하여 아이템카드가 배출되게 하는 등, 최초 등급분류 받은 내용과 다른 내용의 게임물을 손님들의 이용에 제공하고, 손님들이 '골드다빈치' 게임기를 통해 획득한 아이템카드를 1장당 수수료를 제외하고 불상의 금액으로 환전해주었다.
