1. The Plaintiff:

A. Defendant B shall take precedence over each point of Attached Form 1 to 13, and 1, among the land listed in Attached Table 1.

According to the facts that there is no dispute between the parties concerned, and according to the overall purport of Gap evidence Nos. 1 through 11, the results of the survey and appraisal by the Cheongyang branch of the Korea Land Information Corporation, the plaintiff is the owner of each land listed in the separate sheet No. 1, and the defendant Eul occupied each land listed in the separate sheet No. 1, and the defendant Eul owned a brick gate and a pent roof house (unregistered state) with a part of 103 square meters of land listed in the separate sheet No. 103 square meters of land listed in the separate sheet No. 1, and the defendant C owned a brick gate of each land listed in the separate sheet No. 3, 2, 3, 4, 5, 6, 9, and 1 in order to connect each point of "b" of the land listed in the separate sheet No. 1, and all construction materials and the land listed in the separate sheet No. 3, 6, 7, 8, 9, and 9.

2. According to the above facts of determination as to the cause of the claim, unless the Defendants did not prove the source of possessory right to the pertinent land, Defendant B is obligated to remove the above brick boods and boods on each land listed in the separate sheet No. 1 and deliver each of the above land to the Plaintiff. Defendant C is obligated to remove all the above coods and construction materials on the land listed in the separate sheet No. 1, and the above hoos and trees on the land listed in the separate sheet No. 2 as shown in the separate sheet No. 1. 1.

3. As to the Defendants’ assertion, the Defendants asserted to the effect that the former representative of the Plaintiff permitted the use of the pertinent land. Defendant B’s parents paid land usage fees to the Plaintiff, and thus, the implied superficies contract was established. However, there is no evidence to acknowledge this, and Defendant B submitted by Defendant B after the closing of argument alone is recognized.
