Purport of claim and appeal

The judgment of the first instance.

1. The Plaintiff asserted that the Plaintiff provided consulting to the Defendant from March 2018 to May 201 of the same year, and the Defendant concluded a consulting contract with the Defendant to pay 3 million won per month to the Plaintiff in return. Of them, the Plaintiff had already received the payment for March 3, 2018 and April.

Therefore, the defendant is obligated to pay to the plaintiff the consulting cost of May 2018, 300,000 won and delay damages.

2. According to the evidence Nos. 1, 3, and 1 evidence Nos. 1 and 1, the defendant prepared a document (Evidence No. 1) stating "3 million won on June 10, 2018, and 3 million won on July 10, 2018" with the title "the schedule for the unpaid amount of benefits", which is the husband of the inside director of the defendant representative C, of the inside director of the defendant representative C. The defendant deposited KRW 2,802,00 to the plaintiff on June 12, 2018, and the fact that the plaintiff used the defendant's corporate card is recognized.

However, the above evidence No. 1 cannot be deemed to have been prepared in the name of an individual as well as by representing the defendant, and otherwise, the evidence submitted by the plaintiff was entered into a consulting contract between the plaintiff and the defendant as alleged by the plaintiff.

The plaintiff's assertion is without merit, since it is insufficient to recognize that the defendant agreed to pay 3 million won of consulting expenses for May 2018 to the plaintiff.

3. In conclusion, the plaintiff's claim of this case against the defendant should be dismissed as it is without merit. Since the judgment of the court of first instance is just in conclusion, the plaintiff's appeal is dismissed as it is without merit. It is so decided as per Disposition.
