A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
On April 29, 2009, the Defendant was sentenced to one year of imprisonment with prison labor for larceny, etc. at the Daegu District Court. On May 20, 2013, the same court issued a summary order of KRW 500,000 by larceny, etc. on April 25, 2014; the summary order of KRW 3,00,000 by the same court was issued on April 25, 2014; and the summary order of KRW 50,000 by the same court was issued on June 20, 2014.
1. On July 20, 2015, around 23:30, the Defendant opened a door that was parked on the road in front of Daegu-gu C, Daegu-gu, which was owned by the victim D, did not correct the street car, and stolen the instant vehicle with four copies of the Rato lottery ticket equivalent to KRW 9,000 won of the market price in storage in the said vehicle.
The Defendant, including that, from July 12, 2015 to February 21, 201 of the same month, stolen the property amounting to KRW 106,50,00 in total on 15 occasions by the aforementioned method, as indicated in Nos. 1 to 15 attached list of crimes (i.e., “total 92,00 won” with “total 106,50 won”).
2. On July 21, 2015, the Defendant left a H cargo vehicle parked in front of the G Child Care Center in Daegu-gu, Daegu-gu, in order to steal the goods owned by the victim I from the H cargo vehicle that was parked in front of the G Child Care Center. However, the Defendant did not carry the intention on the wind on which the vehicle door is corrected but did not carry out such intention.
The Defendant, including this, attempted to steals property over a total of 50 times from July 20, 2015 to July 21, 2015 by the aforementioned method, as indicated in the annexed Table Nos. 16 to 65.
Accordingly, the defendant habitually stolen or attempted to steal the victims' articles.
