Defendant shall be punished by imprisonment for a term of one year and six months.

Punishment of the crime

[2014 Highest 2862] On December 20, 2013, the Defendant made a false call to the victim D at H 1308 Dong 101, which read “to purchase a Jeju tour ticket that can be used within one year if he/she sent the money.”

However, there was no intention or ability to purchase the Jeju travel ticket even if the defendant received money from the victim because the defendant had to purchase the Jeju travel ticket to other customers at the time, but the money for this was insufficient.

The Defendant received 600,000 won in cash from the Defendant’s Bank account (Account Number: I) in the name of the same day as the purchase price, from the victim, and was remitted KRW 100,000 on March 22, 2014.

From around that time to October 8, 2014, the Defendant made a false statement to the victims in the same manner 18 times as shown in attached Table 1, and received a total of 42,460,000 won from the victims as the price, and from July 28, 2014 to October 1, 2014, the Defendant purchased the card number, password, two pages prior to the card number, travel ticket, etc. for six times as shown in attached Table 2, and then purchased and settled the card number, password, two pages prior to the card number, and the credit card validity period from the victims.

As such, the Defendant acquired property or property benefits by deceiving the victim.

[2014 Highest 3209] On March 17, 2014, the Defendant made a false statement to the VictimJ that “The three-day travel ticket for Jeju-do 2-day gambling is KRW 120,000 per person, and if the Defendant purchased a travel ticket, he/she may travel to Jeju-do on the desired date within one year.”

However, in fact, the defendant was under circumstances to return money with the mother and child travel fee to other customers.
