Reasons
Punishment of the crime
Defendant
A on January 25, 2011, at the Gwangju District Court, sentenced to a suspended sentence of five months to imprisonment for a violation of the Road Traffic Act, etc., and the said judgment became final and conclusive on February 2, 2011, and is currently in the grace period.
1. Defendant B and C’s joint criminal conduct had Defendant C employed Defendant C at KRW 1.50,00 per day to exchange free gifts against customers in the game room.
From March 22, 2012 to February 23, 2012, the Defendants conspired in collusion with the Defendants in front of the parking lot of H Hospital near the Seo-gu F Gameland (U.S. G Gameland) in Gwangju-gu, and exchanged books, which are free gifts acquired after the Defendants enjoying games, with 4,500 won per head, and exchanged them for money exchange of tangible and intangible results acquired through the use of game products for business purposes.
2. Defendant B and Defendant B employed Defendant A at KRW 1.50,00 per day to exchange gift gifts against customers in the game room. Defendant B and Defendant B had expressed a mind to exchange the gift premiums against customers in the game room.
From April 24, 2012 to April 26, 2012, the Defendants conspired to park the JA test owned by Defendant A and exchanged 4,500 won per head to the customers of the said IB, thereby engaging in money exchange business of tangible and intangible results acquired through the use of the game.
3. From May 2, 2012 to May 4, 2012, Defendant A: (a) in the street room near the said I Games; (b) in setting up Otoba, the Defendant carried out business of exchanging 4,500 won per head to the customers of the said I Game by having them enjoy the games, and then having them gain profits from using the games in exchange for 4,500 won per head; and (c) in exchange for tangible and intangible results acquired through the use of the game.
