According to the records, the defendant appealed against the judgment of the court of first instance and asserted only unfair sentencing as the grounds for appeal.

In such a case, the argument that the court below erred in the misapprehension of the legal principles as to the violation of the rules of evidence, mistake of facts, and habitual fraud cannot be a legitimate ground for appeal.

Furthermore, the lower court did not err by misapprehending the legal principles or misconception of facts as alleged in the grounds of appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
