A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

(1) On June 12, 2018, the Defendant: (a) around June 11, 2018, at the time of Gyeonggi-si, Gyeonggi-si; (b) the Defendant provided that “The Defendant shall pay KRW 10,000,000 to the employees D of the victim Co., Ltd. by telephone; and (c) paid KRW 10,000,000 to the Defendant’s account in the name of the Defendant’s father-E (number: : Number: G loan: : 40,000 won as a person with bad credit standing without any property; and (d) the Defendant was paid KRW 377,77, the balance in the name of the Defendant used by the Defendant; and (d) the Defendant did not receive KRW 10,000,00 from the victim’s intent to borrow the above loan and agreed to pay the balance to KRW 28,000,000 from the Defendant’s account at the end of 18,2018.

On August 9, 2015, the Defendant: (a) told the victim H to the effect that “it is intended to receive industrial water from the I factory located in Y, and if the business fund is lent, it would have the victim supply soil and sand at the above construction site.” (b) around August 9, 2015, the Defendant received cash KRW 2,00,000 from the victim on the same day.

However, in fact, the defendant did not have a business entity operated on the above date, and it was thought that the defendant will take over the construction business from a third party to take over the construction business without any particular connection, and was in a state of bad credit standing without any fixed income, so even if he borrowed money from the victim because he did not have the ability to take over the construction business from a third party, he would cause the victim to supply a soil and sand to the above construction, or the victim.
