The punishment of the accused shall be determined by six months of imprisonment.

Punishment of the crime

1. On July 24, 2013, the Defendant, against the victim B, made a false statement to the effect that “A victim B, who was operated by the victim B in Gunsan-si, would have a lack of money in granting advance payment to a fishing vessel. If 8,800,000 won is lent, he/she would sell a good-faith.”

However, even if the defendant received money from the victim, he thought that he would use it as advance payment of fishing vessel, and that he would have had no intention or ability to repay the above money to the victim because he had been in a state of bad credit due to credit occurrence.

Nevertheless, the Defendant, by deceiving the victim as above, received 8.8 million won from the victim, to the F Bank account in the name of E, and received a total of 27.3 million won from the above date and time to February 28, 2014 from the victim, as described in the attached list of crimes.

Accordingly, the defendant was given property by deceiving the victim.

2. On February 2, 2014, the criminal defendant against the victim H made a false statement to the effect that “The victim’s husband H operated by the husband B of the victim H in the Gunsan-si, Sinsan-si, “Any money is required to give advance payment to the fishing vessel. If the victim borrowed KRW 5 million, he/she will sell the vessel and sell it after one month.”

However, even if the defendant received money from the victim, he thought that he would use it as advance payment of fishing vessel, and that he would have had no intention or ability to repay the above money to the victim because he had been in a state of bad credit due to credit occurrence.

Nevertheless, the Defendant deceiving the victim as above and transferred KRW 5 million from the victim, namely, I’s account in the name of J bank (K) to the victim.

Accordingly, the defendant is the victim.
