Reasons
Punishment of the crime
The Defendant is a construction business operator, and the fact is insufficient to properly carry out the construction work because there is no certain revenue or property, so even if another construction business operator is awarded a contract for the interior work from the construction business owner, he did not have the intent or ability to pay the construction cost.
1. On April 29, 201, the Defendant stated that D, a favorable construction business operator at the time of the passenger voting, will give KRW 2,360,00,00 of the construction cost as the completion of the above cosmetic work at the site of the cmination room in Hongcheon-gun, Seocheon-gun, and that D, a glass construction business operator at the time of the passenger voting, would give 2,360,000 won of the construction cost. On May 21, 201, the Defendant made a false statement that 1,250,000 of the construction cost will be paid as the completion of the construction work at the same site.
As such, the Defendant, by deceiving the victim, had the victim do so on the same day and let the victim do so, and did not pay a total of KRW 36.10,000,000 for the construction cost, thereby acquiring property profits equivalent to the above amount.
2. On May 201, the Defendant: (a) performed installation works for the sunlighting of the instant house to the victim E, an outdoor advertisements business operator, at the site of the interior works in the Hancheon-gun, Hongcheon-gun; (b) falsely stated that the Defendant would give KRW 700,000 of the construction cost as the completion of the construction of the instant house to the victim E, who is an outdoor advertisements business operator; and (c) installed the Defendant’s publicity banner for the Defendant’s interior management business operator, and the Defendant would give KRW 230,000 of the construction cost as
Around May 17, 201, the Defendant, by deceiving the victim as such, had the victim install the sunlight of the above house at around May 17, 201, and had the victim install the sunlight of the above house at around May 20, 201, and did not pay a total of KRW 930,000,000.
3. On May 4, 201, the Defendant is a F cafeteria located in Hongcheon-gun B of Gangwon on May 4, 201.
