Reasons
Punishment of the crime
1. Breach of trust;
A. A. Around December 27, 2014, the Defendant organized and operated a 21 fraternity of the victim C, etc., 41 unit of the Gu, 30,000 won of the monthly payment (excluding a fraternity No. 1 and a fraternity that receives fraternity money in the said month, interest shall be additionally paid every month from the date of receiving the fraternity money), 12 million won of the fraternity money to 14,730,000 won of the fraternity ( principal interest 12,000,000 won of the principal x 70,000 won of the interest x f0,000 won).
Although the Defendant had a duty to pay KRW 14.66 million to C, in violation of such duty, the Defendant paid a total of KRW 1,466,00 from the members of the fraternity at a place where the place is unknown on March 27, 2018, to receive the fraternity by receiving a total of KRW 1,466,00 (one million principal interest rate of KRW 70,000 x 38) from the members of the fraternity, the Defendant did not pay the fraternity amount of KRW 14.66 million out of the fraternity amount and did not pay the remainder of KRW 4.66 million.
In addition, from around that time to April 27, 2018, the Defendant did not pay a total of 2,8120,000 won of the fraternity to two victims as shown in attached Table (1)-1 of the List of Crimes (A), thereby obtaining property benefits equivalent to the above fraternity and causing property damage equivalent to the same amount to the victims. However, the victim E did not pay the fraternity amount to be paid on April 27, 2018, and did not pay KRW 7,90,000 (=8730,000 won) - the sum of actual damage amounts to KRW 2,738,00,000,000.
B. Around September 25, 2015, the Defendant organized and operated a number system of 22 members of the fraternity, such as victim E, 35, monthly payment of KRW 330,000 (excluding the fraternity members No. 1 and the fraternity members who receive the fraternity payments in the relevant month, additional payment of interest KRW 70,000 per month after receipt of the fraternity payments), 1,220,000 through KRW 1,353,00 (the principal interest KRW 1,220,000,000 x the interest payment x the head of the household).
The defendant is unable to know the place on July 25, 2018.
