A defendant shall be punished by imprisonment for not less than eight months.

The defendant shall order 40 hours to complete the sexual assault treatment program.

Punishment of the crime

The Defendant is a victim F (F, 15 years of age) and a deadly flag, from July 2013 to July 2014, 2014.

1. 피고인은 2014. 8. 19. 09:21경 스마트폰를 이용하여 피해자에게 “그럼 내가G한테 너나랑한거, H랑한거아냐고 물어봐서 스크린샷찍어보내줄게”라는 내용의 카카오톡 메시지를 보내어 피해자의 남자친구인 G에게 피해자가 피고인, H와 성관계를 한 사실을 알리겠다는 취지로 피해자를 협박한 외에 그때부터 같은 달 2014. 8. 26. 00:10경까지 별지 범죄일람표 기재와 같이 총 8회에 걸쳐 피해자 F를 협박하였다.

2. 피해자 I에 대한 협박 피고인은 자신의 스마트폰을 이용하여 F의 어머니인 피해자 I(여, 38세)에게, 2014. 8. 28. 08:35경 “재가아는 모든사실 F 친구들 한테말할겁니다 다신뵙지말죠”라는 내용의 문자메시지를 보내고, 같은 날 11:18경 “진짜 치가떨릴정도로복수해야죠”라는 내용의 카카오톡 메시지를 보내어, 지인들에게 피해자의 딸인 F의 성관계 동영상을 배포하거나 성관계 사실을 알릴 듯한 태도를 보임으로써 2회에 걸쳐 피해자를 협박하였다.
