A defendant shall be punished by imprisonment for a term of one year and four months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury caused by Dangerous Driving) is a person engaged in driving B radar cars;

At around 04:50 on December 8, 2018, the Defendant, while under the influence of alcohol at 0.116% of the blood alcohol concentration, driven the said car at a point of 21.8 km-gu, Ocheon-si, Ocheon-si, Seocheon-si, Seocheon-si, and driven the said car at a one-lane between the two-lanes in Incheon at the direction of Seoul.

당시는 야간으로 주변이 어두웠으며 2차로에 피해자 C(여, 49세)이 운전하는 D 리오 승용차가 단독사고로 비상등을 켠 채 정차 중이었고 1차로에는 그 사고로 인한 비산물이 흩어져 있어 피해자 E(52세)가 운전하는 F 쏘나타 택시가 속도를 줄이고 서행하고 있었고 그 뒤를 따라 피해자 G(59세)이 운전하는 H K5 택시도 속도를 줄이고 서행하고 있었으므로 이러한 경우 자동차의 운전업무에 종사하는 사람에게는 전방 및 좌우를 잘 살피는 등 안전하게 운전하여 사고를 미리 방지하여야 할 업무상 주의의무가 있었다.

Ultimately, the Defendant, while driving the said car in a situation where normal driving is difficult due to the influence of alcohol, sustained injury such as a heavy-water frame, etc. to the victim I (the 26-year old) who is a partner of the car driving by the Defendant, for about six weeks.
