1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Details of the disposition;

A. From August 12, 2008, the Plaintiff is a person who serves as the president of the C Child Care Center in Jeju-si B.

The plaintiff, while operating the above child care center, entered into a contract by appropriating teaching materials and instructors' allowances in excess of the actual supply price with the provider of the special activity program, and tried to acquire the special activity expenses received by notifying the child care children's guardians of the excessive amount.

On February 2010, the Plaintiff concluded a contract for the provision of a special activity program with a police officer (hereinafter “science instructor fee”) with D, “10,00 won per capita,” and “17,333 won per capita per month,” and “4,458 won per capita,” respectively, and concluded a contract for the provision of a special activity program at a child’s parents’ parent meeting held in the above childcare center around that time, to include “science instructor fee” in the amount of KRW 15,00 per capita, and “3,00 per capita English instruction fee and tuition fee,” and to include “4,5,000 won per capita,” “3,00 won per capita,” and to include “4,5,000 won per person’s English instruction fee and tuition fee,” respectively.

Therefore, on March 1, 2010, the Plaintiff received 35,000 won as “the expenses for teaching materials and instructors in the English language of 4 years old” from childcare children G on March 1, 2010, and illegally received 13,542 won.

The Plaintiff, including that, from March 1, 2010 to March 14, 2013, received 17,230,369 won through 2,560 times through the said method, and at the same time, deceiving the guardians of infant care children, thereby deceiving them.

B. On February 11, 2014, the commissioner of Jeju Provincial Police Agency (hereinafter “the commissioner of Jeju Provincial Police Agency”) recognized the following criminal charges in relation to the Plaintiff and sent them to the prosecution by the Prosecutor’s Office.
