1. The Defendants jointly share KRW 35,000,000 to Plaintiff A, and 5% per annum from June 20, 2016 to August 14, 2018.

1. Facts of recognition;

A. The Plaintiffs and the Defendants are as follows: (a) around 01:00 on June 19, 2016, from the “F club” located in the fifth E-story, Nam-gu, Incheon Metropolitan City around 01:00.

B. On August 3, 2016, the Defendants were indicted on the charges of rapeing and causing injury to the Plaintiffs, and were sentenced to imprisonment with labor for five years (Defendant C) and three years (Defendant D) by imprisonment with labor for the Incheon District Court 2016Gohap511 on January 6, 2017.

The Defendants appealed against this and appealed to Seoul High Court No. 2017No258 (hereinafter “related cases”) and were sentenced to imprisonment on May 16, 2017 (Defendant C) and imprisonment on June 201 and imprisonment on June 200 (Defendant D). The above judgment became final and conclusive as it is.

The Defendants, who were prescribed by Defendant D, had the Plaintiffs stroke-m and stroke-mix the drugs containing the stroke-mm and stroke-mick, mixed with the main string, and sentenced the Plaintiffs to rape.

2016. 6. 19. 02:30부터 03:00경 사이에 피고 D은 미리 처방받아 가지고 있던 졸피뎀 및 알프라졸람 성분이 든 약을 오렌지 주스에 넣어 녹여 이를 두 개의 잔에 나누어 담고 피고 C에게 그 중 한 잔을 건네 준 다음 원고들에게 먹일 목적으로 위와 같이 약을 탄 오렌지 주스가 든 잔을 각자 양손에 한 잔씩 들고 원고들에게 다가가 ‘술 아니야, 건배하자.’라고 말하면서 자신들의 잔에 든 음료를 먼저 모두 마시고 빈 잔을 머리 위로 들어 올려 거꾸로 털면서 ‘원샷’이라고 말하는 모습을 보이는 등 원고들을 안심시켜 원고들로 하여금 위와 같이 약이 든 오렌지 주스를 마시게 하였다.

The Defendants: (a) Defendant C, having the Plaintiff drive a vehicle owned by the said Plaintiff on the same day at around 03:25 of the same day; (b) had the Plaintiff engage in sexual intercourse once with the Plaintiff, who was in a state of failing to resist due to the Plaintiff’s refusal to do so by taking the drug as above; and (c) caused the Plaintiff to have sexual intercourse with the Plaintiff.
