피고인은 2017. 2. 14. 19:20 경 약 158명 정도가 있는 ‘ 카카오 톡’ 단체 채팅 방에서, ‘B’ 이라는 아이디를 사용하는 C이 피고인에게 밤늦은 시간에 광고성 메시지를 보낸 것에 항의하자, 피해자를 지칭하면서 ‘ 폰 하라고 개씹 보지 년 아’, ‘ 씹좆 같은 소리하지 말고’, ‘ 병신 같은 씨 팔 년 아’, ‘ 야 개 보지 년 아 보지 나 잘 닦어’ 라는 등의 메시지를 전송하여 공연히 피해자를 모욕하였다.
