1. The Defendants traded on July 31, 2019 with respect to one half of each share of the real estate listed in the separate sheet to the Plaintiff.
Reasons
1. Basic facts
A. On February 27, 2013, the Defendants obtained approval of a public rental housing construction project plan with respect to multi-family housing in Sejong Special Self-Governing City (hereinafter “D”) and completed registration for the preservation of each ownership among each household of D on December 11, 2015 after completion of D.
B. On March 27, 2015, the Plaintiff entered into a contract with the Defendants on the following terms and conditions of the lease and lease agreement with respect to E (hereinafter “instant apartment”) among D (hereinafter “instant apartment”). Of them, the parts relating to the conversion for sale in lots are as follows:
“A” under a lease agreement/ below: Defendants, “B”: Plaintiff 1 (lease deposit, rent, and lease contract period)
1. “A” means the lease to “A, with the following terms: (a) the deposit, rent, and the lease contract term;
(1) Article 2 (Special Terms and Conditions -1) - The date of occupancy of the above rental house of KRW 160,00,000, monthly rent of KRW 200,000(rental house of KRW 200,00) shall be 2.5 years from the first day of the first occupancy period (the period of lease obligation shall be 5 years, but the period of lease obligation shall be 1/2 of the period of lease obligation under Article 13(2)3 of the Enforcement Decree of the Rental Housing Act shall be 2.5 years from the first day of the first occupancy period (the period of lease obligation shall be 5 years, 1/2 of the lease obligation under Article 13(2)3 of the Enforcement Decree of the Rental Housing Act) (1) this house shall be converted for sale at the expiration of 5 years and is scheduled to be converted for sale at the expiration of 1/2 of the lease obligation period.
“A” under the Revised Terms and Conditions Agreement: The Defendants, and “B” are for the purpose of changing Plaintiff 1(Purpose) into a pre-sale lease agreement in order to reduce the burden of monthly rent, setting a fixed amount of amount due to conversion for sale in lots, and setting the conversion for sale in lots, and this amendment agreement (a contract).
