Reasons
Punishment of the crime
“The 2016 Highest 4581 – Defendant A and the Defendants, together with C and G, shall advertise loans in a living information site and receive necessary documents for loans from the loan applicant, and then receive the loan from the loan applicant, and then pay a certain amount of the loan to the loan applicant, and then pay an additional amount promised after the loan is made.
In other words, most of the borrowed money were ambiguousd by the Defendants.
1. Fraud against victim H;

The victim H, who had contacted, stated that “to have a loan-related work, and if a loan is made, to have a money borrowed as working expenses,” was permitted to grant a loan from the victim.

A around that time, A applied for a loan of KRW 5 million and KRW 8 million to the SBI Savings Bank and the OF Savings Bank in the name of the victim, and received the above amount from the Agricultural Cooperative Account in the name of the victim. Defendant B, around September 12, 2016, at the office of the 236 Gwangju Agricultural Cooperative, U.S., U.S., U.S., Seoul, requested the victim to make a cash card and withdrawn KRW 6 million from the cash withdrawal period, and paid KRW 1 million to the victim in a lump sum with additional loans.

However, the Defendants did not intend to receive all additional loans only when they paid only some amount of the borrowed money and thought that they will have the remainder in full.
As such, the Defendants conspired with C, etc., deceiving the victim, thereby deceiving 5 million won from the victim.
B. On September 13, 2016, Defendant A applied for a loan of KRW 40 million to a financial loan business entity sent under the name of the victim in the same manner as that of the preceding paragraph at the 381 Gwangju Seo-gu Office, Seogu, Seoul, Seo-gu, Seoul, and in the same manner as that of the preceding paragraph, the above amount to the Agricultural Cooperative account in the name of the victim.
