Reasons
Punishment of the crime
The defendant is a person who operates livestock pens in Jin-si, which is located in C (a square of the area of approximately 439m, swine 400m, report on the installation of facilities for discharging livestock excreta), and livestock pens in D, such as livestock pens (a square of the area of approximately 1171.25m, swine 800m, permission for the installation of facilities for discharging livestock excreta).
No person who discharges, collects, transports, disposes of, or spreads livestock excreta shall commit an act of flowing or threatening to bring livestock excreta into the public waters as defined in subparagraph 9 of Article 2 of the Water Quality and Aquatic Organisms Conservation Act (hereinafter referred to as "public waters") or into the public waters as defined in subparagraph 9 of Article 2 of the same Act.
1. On February 22, 2017, the Defendant, at a livestock shed operated by the Defendant, installed a rain farm facility to prevent livestock excreta in a storage tank, which is an emission facility at the time of rainfall from being discharged, from being leaked to the outside, and thoroughly takes measures to treat waste, and neglected to take more care of the management by transferring livestock excreta to a treatment facility so that the quantity of livestock excreta stored can maintain the adequate level of the livestock excreta, or entrusting it to the treatment company in advance, thereby passing livestock excreta over from the storage tank and passing it into the marina port, which is a public water area.

From February 23, 2017 to February 28, 2017, the Defendant neglected to pay more attention to the management as described in paragraph (1) so that livestock excreta in a compost company, which is a storage and treatment facility, which is an emission facility, from a livestock shed operated by the Defendant from a livestock shed operated by the said Defendant, do not flow out to the outside and flow out to the outside, thereby passing livestock excreta from a storage and compost company.
3. On April 17, 2017, the Defendant neglected to pay more attention to the management as described in paragraph (1) to prevent livestock excreta in a storage tank, which is an emission facility, from flowing over and leaking out in the stable as described in paragraph (1).
